Information form for travellers on a package holiday under Section 651a of the German Civil Code

The combination of travel services offered to you is a package holiday within the meaning of Directive (EU) 2015/2302.

You can therefore claim all EU rights that apply to package holidays. Elefant-Tours GmbH bears full responsibility for the proper performance of the entire package holiday.

In addition, Elefant-Tours GmbH has the legally required protection for the refund of your payments and, if transport is included in the package holiday, to ensure your repatriation in the event of its insolvency.

Further information on your most important rights under Directive (EU) 2015/2302

Main rights under Directive (EU) 2015/2302

  • Travellers will receive all essential information about the package before concluding the package travel contract.
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
  • Travellers are given an emergency telephone number or details of a contact point through which they can contact the organiser or the travel agent.
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs (for instance fuel prices) rise and if this is expressly provided for in the contract, and in any event no later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract. If an organiser reserves the right to increase the price, the traveller is entitled to a price reduction if the relevant costs decrease.
  • Travellers may terminate the contract without paying any termination fee and receive a full refund of all payments if any of the essential elements of the package, other than the price, is significantly changed. If the trader responsible for the package cancels the package before its start, travellers are entitled to a refund and, where applicable, to compensation.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • In addition, travellers may terminate the contract at any time before the start of the package in return for payment of an appropriate and justifiable termination fee.
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements must be offered to the traveller at no extra cost. The traveller may terminate the contract without paying any termination fee (in the Federal Republic of Germany this right is called “termination”) where services are not performed in accordance with the contract and this substantially affects the performance of the package travel services and the organiser fails to remedy the problem.
  • The traveller is entitled to a price reduction and/or compensation for damages if the travel services are not performed or not performed properly.
  • The organiser must provide assistance to the traveller if the traveller is in difficulty.
  • In the event of the insolvency of the organiser or – in some Member States – of the retailer, payments will be refunded.

If the insolvency of the organiser or, where relevant, the retailer occurs after the start of the package and transport is included in the package, repatriation of the travellers is guaranteed. Elefant-Tours GmbH has taken out insolvency protection with R+V Allgemeine Versicherung AG. Travellers may contact this entity or, where applicable, the competent authority (R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, +49 611 533-5859, ruv@ruv.de) if services are denied to them because of the insolvency of Elefant-Tours GmbH.
